Grounds of Appeal - Clamp & Remove

These are the only grounds on which you may appeal where the vehicle has been clamped or removed

  1. The contravention did not occur
    For example, the parking restrictions were not properly signed or the contravention did not happen as stated on the Penalty Charge Notice

  2. The vehicle was parked by someone in control of it without my consent
    For example, the vehicle was improperly parked after being stolen

  3. A current disabled person’s badge was displayed on the vehicle
    This applies to vehicles displaying a disabled person’s badge that have been clamped. It does not apply to vehicles that have been removed (towed away).

  4. Less than 15 minutes had elapsed after time paid for expired
    However, a penalty charge notice may be issued immediately a contravention occurs.

  5. The penalty exceeded the amount applicable in the circumstances of the case
    For example, you are being asked to pay the wrong amount for the penalty charge and/or release fees.

  6. The relevant traffic order was invalid
    This only applies if the authority’s regulations are legally defective.
